All educational events/sessions shall be sponsored by the Maryland Health
Information Management Association, Inc.

Rationale: |
According to the MdHIMA bylaws Article V- Section 5.1, “the property, business,
and affairs of this Association shall be managed and controlled by the Executive
Board”. In order to accomplish the Association’s “business and affairs”, each
standing committee has been delegated specified functions and responsibilities
by either the bylaws or the Executive Board. In other words, each standing
committee is an agent of the Association (Executive Board). Under the legal
doctrine of respondent superior, the master is answerable for the acts of his
agents or servants. In this case, the master is the controlling agent of the
Association and is otherwise known as the Executive Board.
Consistently, one who assumes the ultimate responsibility for some other person
or things is known as a sponsor. Since the Association in the hands of the
Executive Board has ultimate responsibility for the “business and affairs”, it
is legally and organizationally proper to identify the Association as the
sponsor of educational events/sessions. |
